The documents are structured with clear legal-style headings and bullet points for readability, followed by detailed explanatory paragraphs that provide context, rationale, and compliance analysis for each section.

Explanatory Paragraph

CuraVista Global’sTM Terms & Conditions apply to all users engaging with its services, whether as medical tourists, wellness product customers, or religious travelers. The company acts as a facilitator, connecting clients with hospitals, clinics, hotels, logistics providers, and product manufacturers. For medical and wellness tourism, CuraVista GlobalTM coordinates the entire patient journey, from initial inquiry to post-treatment care, leveraging partnerships with accredited healthcare providers in India. In product distribution, CuraVista ensures compliance with EU and Indian regulations for Ayurvedic and wellness goods, managing both direct-to-consumer and B2B sales. Religious tourism packages are curated to meet the spiritual, logistical, and cultural needs of pilgrims, with attention to visa, insurance, and local compliance requirements.

3. BOOKING AND PAYMENT TERMS

3.1. Booking Process

- Bookings for medical, wellness, and religious tourism services are confirmed upon receipt of a completed application and required documentation.
- Product orders are accepted via CuraVista Global’sTM website or authorized B2B channels.

3.2. Payment Methods

- Accepted payment methods include credit/debit cards, wire transfers, and approved digital wallets.
- All payments must be made in the currency specified at the time of booking or order.

3.3. Deposits and Final Payments

- For tourism services, a non-refundable deposit (typically 20–30% of the total package price) is required to secure the booking.
- The balance is due no later than 30 days prior to the scheduled departure or treatment date.
- Product orders must be paid in full at the time of purchase unless otherwise agreed in writing.

3.4. Pricing and Currency

- Prices are quoted inclusive of applicable taxes and fees, unless stated otherwise.
- CuraVista GlobalTM reserves the right to adjust prices due to currency fluctuations, changes in supplier costs, or regulatory changes.

Explanatory Paragraph

The booking and payment terms are designed to provide transparency and predictability for clients while protecting CuraVista GlobalTM from last-minute cancellations and currency risks. Deposits secure the client’s place and enable CuraVista to make advance payments to hospitals, hotels, and other partners. The requirement for full payment prior to service delivery aligns with industry standards in both medical tourism and e-commerce, mitigating the risk of non-payment and ensuring smooth logistics. Currency and pricing clauses reflect the volatility of international transactions and the need to pass on unforeseen cost increases only when justified.

4. PRODUCT ORDERS AND DELIVERY

- Orders may be declined or modified in the event of pricing errors, regulatory restrictions, or supply chain disruptions.

- Ayurvedic products and mattresses are warranted to be free from material defects at the time of delivery, subject to applicable EU and Indian consumer protection laws.

Explanatory Paragraph

CuraVista Global’sTM product order and delivery terms reflect the complexities of cross-border e-commerce, particularly for regulated goods like Ayurvedic products. The company adheres to EU requirements for product labeling, safety, and consumer rights, including the two-year legal guarantee for conformity under EU law. Delivery timelines are estimates, not guarantees, due to the unpredictability of international shipping and customs processes. Customers are advised to familiarize themselves with local import regulations and taxes to avoid unexpected charges upon receipt.

Non-refundable deposits cover administrative costs and supplier commitments. The tiered refund schedule incentivizes early cancellations, reducing last-minute disruptions. For product returns, CuraVista GlobalTM complies with EU distance selling regulations, including the right of withdrawal for online purchases, while ensuring that returned goods are fit for resale. Exceptions for medical emergencies and visa denials demonstrate flexibility and empathy, subject to documentation.

6. HEALTH AND TRAVEL RESPONSIBILITIES

6.1. Medical Disclosure and Informed Consent

- Clients must provide accurate and complete health information as requested during the booking process.
- CuraVista GlobalTM and its partners rely on this information to recommend appropriate treatments and services.
- Clients are responsible for obtaining independent medical advice and confirming fitness to travel.

6.2. Vaccinations, Visas, and Travel Documents

- Clients acknowledge that medical outcomes cannot be guaranteed and that all treatments carry inherent risks.

Explanatory Paragraph

Health and travel responsibilities are critical in medical and religious tourism. CuraVista Global’sTM policy emphasizes the importance of full medical disclosure and informed consent, in line with international best practices and legal precedents. Clients are reminded that ultimate responsibility for health, documentation, and insurance lies with them, not the facilitator. The company’s role is to provide information, coordination, and support, not to replace professional medical or legal advice. Insurance is strongly recommended to mitigate financial risks associated with unforeseen events, as required by many destination countries and industry standards.

7. LIABILITY DISCLAIMERS AND LIMITATIONS

7.1. General Disclaimer
- CuraVista GlobalTM acts as an intermediary, facilitating arrangements between clients and third-party providers (hospitals, clinics, hotels, transport, product manufacturers). - The company is not liable for the acts, omissions, or negligence of third-party providers.

7.2. Medical Disclaimer

- Information provided by CuraVista GlobalTM is for informational purposes only and does not constitute medical advice, diagnosis, or treatment.
- Clients must consult qualified healthcare professionals for medical decisions.

7.3. Limitation of Liability

- CuraVista Global’sTM total liability for any claim arising from its services is limited to the amount paid by the client for the specific service or product in question.
- The company is not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or opportunity.

7.4. Force Majeure

- CuraVista GlobalTM is not liable for delays, cancellations, or failures caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, government actions, or supplier insolvency.

Explanatory Paragraph
Liability disclaimers are essential for businesses operating in high-risk, cross-border sectors like medical tourism and e-commerce. CuraVista Global’sTM clauses are modeled on industry best practices and legal templates, limiting exposure to direct damages and excluding liability for third-party actions and unforeseeable events. The medical disclaimer clarifies that CuraVista does not provide medical care, aligning with regulatory requirements and reducing the risk of malpractice claims. The force majeure clause protects both parties from obligations rendered impossible by extraordinary circumstances.

8.3. Third-Party Content

- The website may contain links to third-party websites or content. CuraVista GlobalTM does not endorse or assume responsibility for such content.

Explanatory Paragraph

Intellectual property protection is vital for safeguarding CuraVista Global’sTM brand, digital assets, and proprietary information. The terms prohibit unauthorized use of content, reflecting standard e-commerce and digital service agreements. Third-party content disclaimers clarify that CuraVista is not responsible for external sites, reducing legal exposure for user-generated or linked material.

9.3. Jurisdiction for Product Sales

- For product sales to consumers in the EU, mandatory consumer protection laws of the buyer’s country of residence may apply.

Explanatory Paragraph

The choice of governing law and arbitration reflects the international nature of CuraVista Global’sTM business and the need for predictable, efficient dispute resolution mechanisms. Arbitration is widely recognized as a preferred method for cross-border commercial disputes, offering enforceability under the New York Convention and reducing litigation risks. The clause also acknowledges the applicability of mandatory consumer protection laws in the EU, ensuring compliance with local regulations and the International Code for the Protection of Tourists.
